IMPORTANT: PLEASE READ CAREFULLY. Before downloading, installing, or utilizing this software, including any of its components, media, printed materials, or electronic guides (collectively referred to as the “product”), you must thoroughly review this End User License Agreement. To finalize your order, you are required to check and consent to these terms. By completing the installation, duplicating, or running the product, you legally consent to be bound by this contract. This document constitutes the definitive and exclusive agreement regarding the product between you and StreamByte, superseding all previous discussions, negotiations, arrangements, or commitments. Please note that this agreement incorporates an arbitration clause.

Section 1: Intellectual Property Rights

The product is protected by copyright and other intellectual property laws, and all intellectual property rights in and to the product belong to StreamByte and its subsidiaries. Further, all right, title, and interest, including all intellectual property rights, in and to the content (including but not limited to videos, audio, music, and streams) which may be accessed, parsed, or downloaded through use of the product is the property of the respective content owner or third-party streaming platforms, and is protected by applicable copyright or other intellectual property laws and treaties. This Agreement grants you no rights to use, copy, distribute, or commercially exploit such content. You acknowledge that the product is solely a tool for personal use.

StreamByte retains all rights that are not explicitly bestowed upon you herein. The product is granted under license and is not disposed of by sale. You are strictly forbidden to replicate, distribute, broadcast, alter, prepare derivative adaptations of, openly show, or publicly execute the product. Except for the explicit permissions detailed in Section 2 hereunder, any duplication or retention of the product is disallowed without acquiring the advance written authorization of StreamByte.

Section 2: License Grant, Prohibited Uses and Third-Party Terms Compliance

Under the terms and conditions outlined in this Agreement, StreamByte grants you a limited, non-transferable, non-sublicensable, and non-exclusive license to run the product on the designated number of computers for which you have paid. These devices must operate under a legally licensed version of the intended operating system. This license is restricted to your personal or internal corporate use. A single backup copy may be created for archival purposes, provided it is only accessed when the original software copy is not running.

Modifying or removing copyright notices on any copy of the product is strictly forbidden. You may not operate the product on a computer network or permit concurrent use by more than one user at a time. Furthermore, you are prohibited from renting, leasing, or transferring the product to third parties. Unless expressly authorized by applicable law, you may not decompile, reverse engineer, disassemble, or attempt to do so to the product. Any supplemental or patch code delivered by StreamByte to fulfill agreed-upon support services will be classified as part of the product and will be governed entirely by this Agreement.

You must comply with all applicable laws regarding the use of the product. You agree that you shall use the product in strict compliance with the Terms of Service (ToS), policies of any third-party streaming platforms from which you download media. You are strictly prohibited from using the product to circumvent Digital Rights Management (DRM) technologies or copy-protection mechanisms for unauthorized commercial distribution. The product shall only be used to download content where you have the legal right to do so, or where such download constitutes a "Fair Use" under applicable copyright laws.

Section 3: Trial Version

If you have received, downloaded and/or installed a trial version of the product and are hereby granted an evaluation license for the product, you may use the product only for evaluation purposes and only during the single applicable evaluation period, unless otherwise indicated, from the date of the initial installation. Any use of the product for other purposes or beyond the applicable evaluation period is strictly prohibited. Trial versions may contain functional limitations, including but not limited to restrictions on the length, resolution, or number of downloads.

Section 4: Installation

Installation of the Licensed product is restricted to one copy on a single device, and you must be the principal user of the device where the software is installed. The terms of this Agreement apply to each instance of the Licensed product installed. Deploying the Licensed product on two or more devices concurrently is prohibited; to use the software on multiple devices, you need to purchase the appropriate number of licenses. You shall bear sole responsibility for any costs or fees associated with installing and using the Licensed product.

Section 5: Software Improvement Program

StreamByte is committed to helping protect your privacy at all times except as otherwise provided in this Agreement. This statement explains the anonymous data collection process and usage practices for the Software Improvement Program of StreamByte.

In order to provide and improve the product, its features, and users’ experience, StreamByte will automatically collect, maintain, process, and use information concerning the way the various modules and functionalities of the StreamByte product are being used. This may include anonymous technical logs such as conversion success rates, software crash reports, and interface utilization metrics. No personal data or history of downloaded URLs will be monitored, disclosed, or shared.

StreamByte uses this data solely to conduct statistical analysis on product performance and usage, delivering a better software experience to end users. Under no circumstances will the gathered information be disclosed, disseminated, commercialized, bartered, or leased to any third-party entities for promotional or marketing objectives. If you do not want to participate in this improvement program, you can easily opt out through the advanced settings screen during the software installation.

Section 6: Activation

To prevent unlicensed or illicit use, the Licensed product includes digital rights management and built-in technological controls. This security technology may restrict how many times the Licensee can install or uninstall the Licensed product on a specific computer, the total number of allowed devices, and the license duration according to the purchased plan. You may be required to activate the Licensed product during installation or as directed in the product Documentation. Failing to follow the necessary activation steps means the Licensed product might only operate for a limited trial period. If activation is required but not completed within the timeframe set in the Documentation or installation guide, the Licensed product will stop working until it is fully activated, at which point its features will be restored. Section 7: License Transfer

Licensee may not rent, lease, lend, sell, assign, sublicense, redistribute, or transfer the Licensed product or the License granted by this EULA without prior written consent of StreamByte.

Section 8: Warranty Disclaimer

Subject to the provisions of Section 4 above, the product is being licensed on an “AS IS” and “WITH ALL FAULTS” basis without any express or implied warranty of any kind. The entire risk as to the quality and performance of the product is with you, and should the product prove defective, you and not StreamByte assume the entire cost of all necessary servicing or repair.

To the extent permitted by law, StreamByte disclaims all other warranties on the product, either express or implied, including but not limited to the implied warranties of merchantability, non-infringement of third-party rights, and fitness for a particular purpose. Further, StreamByte does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links, or other items contained within the product.

You expressly acknowledge that third-party streaming platforms may update their website structures, source codes, streaming protocols, or encryption/security algorithms. StreamByte shall not be held liable if such third-party alterations cause temporary unavailability of the product's download functions.

StreamByte makes no warranties concerning any harm arising from the transmission of viruses, worms, time bombs, logic bombs, or other such computer programs. Furthermore, StreamByte expressly disclaims any representation or warranty to any third party or authorized user. Any statutorily required warranty duration is limited to the term of this limited warranty. Notwithstanding the above, you may hold other rights which vary by jurisdiction, state, or country.

Section 9: Disclaimer of Consequential Damages

StreamByte shall under no circumstances be liable for any consequential or incidental damages arising from the use of, or the inability to use, the product. This disclaimer encompasses, without limitation, computer malfunction, work interruption, data loss, legal claims, or account bans on third-party platforms related to content downloads, regardless of whether the Company has been advised of such risks. Because the laws in some jurisdictions do not allow the exclusion of liability for incidental or consequential damages, these limitations might not apply to your specific case.

Section 10: Limitation of Liability

StreamByte shall have no liability with respect to the content of the product or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, loss of privacy, moral rights, or the disclosure of confidential information. StreamByte’s total liability shall in no event exceed the actual price paid for the product.

If the product is subject to a threatened, potential, or actual claim of infringement of another’s right for which StreamByte may be liable, the Licensee will make prompt and reasonable efforts to stop using and delete the product upon receiving the Company’s written notice (including by email). StreamByte may provide Licensee with a replacement, updated, or modified product free of charge. In such circumstances, StreamByte shall not bear other liabilities to you.

Section 11: Export Control

The United States governs the export of products and information. You agree to adhere to these restrictions and undertake not to export or re-export the product to any countries or individuals prohibited under export control regulations. By downloading the product, you represent and warrant that you are not situated in a country where such export is forbidden, nor are you a person or entity subject to such export prohibitions. You hold sole responsibility for complying with the laws of your local jurisdiction regarding the import, export, or re-export of the product.

Section 12: Taxes

You shall be responsible for the payment of all sales, use, and similar taxes relating to the license of the product.

Section 13: Termination

Without prejudice to any other rights, StreamByte may terminate this Agreement if you fail to comply with the terms and conditions set forth herein. In such an event, you must destroy all copies of the product in your possession.

Section 14: Miscellaneous

StreamByte does not allow you to utilize our product to do anything that violates the local law or infringes any party’s rights or intellectual property. If you utilize our software to perform illegal downloading activities, commercially redistribute copyrighted media, or violate the copyright laws of your jurisdiction and the service terms of third-party platforms, the consequent results, statutory damages, and legal implications shall be on your own sole responsibility. If you utilize our software to do illegal activity or infringe on others’ rights, the consequent result shall be on your own responsibility. If you disagree with this item, please don’t install and/or use the software product.

StreamByte may not be used by adolescents to download and process the content of any illegal, obscene, pornographic, or other violations of public order and morals.

To the maximum extent permitted by applicable law, we reserve the right of final interpretation at our sole discretion.
